Merdilo - Intelligent Dog Monitoring

1. General Provisions

These Terms of Service govern the use of the Merdilo mobile application ("App") and the provision of electronic services by:

Using the App constitutes acceptance of these Terms of Service and the Privacy Policy.

These Terms of Service constitute the terms of service as referred to in Art. 8 of the Act of 18 July 2002 on the Provision of Electronic Services (Polish law).

Before using the App, the User is required to read these Terms of Service and the Privacy Policy.

In accordance with Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market for Digital Services (Digital Services Act, DSA), the Service Provider has designated a contact point for communication with EU Member State authorities, the European Commission, and Users on matters covered by the DSA. 2. Definitions

  • Service Provider - Software Damian Wiliński
  • App - the Merdilo application available on iOS, Android, macOS and Windows
  • User - a natural person who is at least 16 years old and uses the App
  • Account - the User's individual account in the App
  • Transmitter Device (Camera) - a device left with the dog that records and transmits video/audio
  • Receiver Device (Viewer) - a device on which the User watches the stream
  • Monitoring Session - a period of active transmission between the Transmitter and Receiver Devices
  • AI Analysis - automatic classification of dog sounds by artificial intelligence
  • Subscription - a paid plan extending the App's functionality
  • Agreement - a contract for the provision of a digital service within the meaning of the Act of 30 May 2014 on Consumer Rights (hereinafter: "Consumer Rights Act"), under which the Service Provider undertakes to provide the User with the App Service
  • Non-conformity - non-conformity of the Service with the Agreement, the assessment criteria of which are defined in Art. 43k(1-2) of the Consumer Rights Act
  • User Content - any data (including dog personal data), files, information and materials saved by the User in their Account
  • Consumer Rights Act - the Act of 30 May 2014 on Consumer Rights (Polish law)
  • Electronic Services Act - the Act of 18 July 2002 on the Provision of Electronic Services (Polish law)

3. Service Description

The Merdilo App enables:

  • Dog monitoring - real-time video and audio transmission between devices
  • AI behavioral analysis - automatic detection of barking, whimpering, howling and other dog sounds
  • Push notifications - instant alerts about detected events
  • Event history - browsing previous sessions and alerts
  • AI reports - behavioral summaries after sessions
  • Two-way communication - ability to talk to the dog through the Transmitter Device

3.1. Operating Modes

  • Transmitter Mode (Camera) - the device records and transmits video/audio, analyzes audio via ML
  • Receiver Mode (Viewer) - the device receives the transmission and displays a live preview

4. Technical Requirements

The following are required to use the App:

  • Operating system: iOS 14.0 or later / Android 8.0 (API 26) or later / macOS 12.0 or later / Windows 10 or later
  • Internet connection: stable Wi-Fi or mobile data (recommended min. 2 Mbps)
  • Permissions: camera, microphone and notification access
  • Two devices: one as Transmitter, another as Receiver

The Service Provider does not guarantee proper functioning of the App on devices that do not meet the above requirements.

5. Registration and User Account

5.1. Requirements

  • Users must be at least 16 years old
  • Registration requires providing truthful information
  • One User may have one Account

5.2. Registration Methods

  • Email address and password
  • Google account (Google Sign-In)
  • Apple account (Sign in with Apple)

5.3. Account Responsibility

The User is responsible for:

  • Maintaining the confidentiality of login credentials
  • All activities performed on their Account
  • Promptly notifying the Service Provider of any unauthorized access to the Account

5.4. Account Deletion

The User may delete their Account at any time:

Account deletion is irreversible and results in permanent deletion of all User data.

5.5. Data Export

Before deleting their Account, the User has the right to:

  • Download their data in JSON format
  • Request transfer of data to another system

Data is made available within 30 days of submitting a request to contact@merdilo.com.

After Account deletion, User data is archived for 30 days and then permanently deleted. Data required by law (e.g., accounting documentation) is retained for the period required by regulations.

6. Rules of Use

6.1. Permitted Use

The App is intended exclusively for:

  • Monitoring your own pets (dogs)
  • Monitoring animals for which the User has the right of care
  • Personal, non-commercial use

6.2. Prohibitions

The User agrees not to:

  • Record persons without their consent
  • Use the App for surveillance or violating the privacy of others
  • Use the App in any unlawful manner
  • Attempt to gain unauthorized access to the Service Provider's systems
  • Modify, decompile or distribute the App
  • Use the App for commercial purposes without the Service Provider's consent
  • Share their Account with third parties

Warning: Violation of the above prohibitions may result in suspension or deletion of the Account and legal liability.

6.3. Monitoring Obligations

When using the audio and video monitoring features, the User agrees to:

  • Inform household members and persons present in the room about the active audio-video monitoring
  • Direct the camera only at the dog's area - not at private zones of household members
  • Place visible monitoring information in the room where the Transmitter Device operates

Legal warning: Recording persons without their knowledge and consent may constitute a criminal offense under applicable law. The User bears sole responsibility for lawful use of the monitoring features.

7. Subscriptions and Payments

7.1. Available Plans

The App offers various subscription plans, including a free plan and paid premium plans with extended features.

Current prices and detailed description of each plan's features are available in the App and on App Store / Google Play.

7.2. Payments

  • Payments are processed through App Store (iOS) or Google Play (Android)
  • Prices include applicable taxes
  • Payment is charged to the Apple ID or Google account upon purchase confirmation

7.3. Auto-Renewal

  • Subscriptions automatically renew for the next billing period
  • Renewal charges are applied within 24 hours before the end of the current period
  • Auto-renewal can be turned off in App Store / Google Play settings

7.4. Cancellation

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • After cancellation, you retain access to premium features until the end of the paid period
  • Cancellation is done in App Store / Google Play settings, not in the App

7.5. Refunds

Refunds are handled according to App Store or Google Play policies:

7.6. Right of Withdrawal

Under Art. 27 of the Consumer Rights Act, a User who is a consumer has the right to withdraw from the Agreement without giving any reason within 14 days from the date of its conclusion. The withdrawal statement may be submitted in any form, including on the form constituting Annex 2 to the Consumer Rights Act, to contact@merdilo.com.

The Service Provider shall promptly send the User confirmation of receipt of the withdrawal statement.

In accordance with Art. 38(13) of the Consumer Rights Act, the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium, if the performance has begun with the consumer's prior express consent before the expiry of the withdrawal period and after being informed of the loss of the right of withdrawal.

Before subscription activation, the User will be asked to expressly consent to the immediate commencement of the service and to acknowledge the loss of the right of withdrawal. Confirmation is recorded on a durable medium (purchase confirmation email from App Store / Google Play).

8. Intellectual Property Rights

All components of the App, in particular its name, logo, interface, graphics, software, source code, AI models and databases, are protected under:

  • The Act of 4 February 1994 on Copyright and Related Rights
  • The Act of 30 June 2000 - Industrial Property Law
  • The Act of 16 April 1993 on Combating Unfair Competition
  • Other generally applicable legal provisions, including European Union law

The User receives a non-exclusive, non-transferable license to use the App in accordance with its purpose.

Any use of the Service Provider's intellectual property without prior express permission is prohibited. In particular, copying, modifying, distributing or decompiling the App is prohibited.

9. Limitation of Liability

9.1. Service Availability

The Service Provider makes efforts to ensure the App works properly, however:

  • Does not guarantee uninterrupted and error-free operation of the App
  • Reserves the right to technical breaks for maintenance and updates
  • Is not responsible for interruptions caused by factors beyond its control (network outages, third-party actions)

9.2. Artificial Intelligence (AI)

The App uses the following AI technologies:

  • On-device audio classification (on-device ML) - YAMNet model and a dedicated Merdilo model, running locally on the User's device. Raw audio recordings are not sent to servers
  • AI behavioral analysis (Google Cloud) - Google Gemini 2.5 Flash model, processing aggregated session metadata (not raw recordings) in the EU region (Warsaw, Poland). Data is not used by Google to train AI models

Important: Results generated by AI may contain errors and inaccuracies. AI analysis is purely auxiliary and informational - it does not constitute veterinary advice and does not replace direct care of the animal.

  • The Service Provider is not liable for incorrect classifications (false alarms or missed alerts)
  • The Service Provider is not liable for damages resulting from relying solely on App alerts
  • The User should treat the App as a supporting tool, not a replacement for personal care
  • AI-generated content (behavioral reports) is made available to the User, but may not be subject to copyright protection

9.3. Limitation of Liability

To the maximum extent permitted by mandatory applicable law, the Service Provider shall not be liable for damages that are not a normal consequence of non-performance or improper performance of the contract, in particular for:

  • Loss of data not caused by the Service Provider's actions
  • Damages resulting from the actions of third parties
  • Damages caused by force majeure

The above limitations do not apply to liability for damages caused intentionally or through gross negligence, and do not limit consumer rights under mandatory provisions of applicable law.

9.4. Force Majeure

The Service Provider shall not be liable for non-performance or improper performance of services due to force majeure, understood as external events that are impossible to foresee and prevent (e.g., natural disasters, wars, pandemics, telecommunications infrastructure failures).

10. Termination

10.1. Termination by the User

The User may at any time:

  • Cancel their Subscription (through App Store / Google Play)
  • Delete their Account (in the App or by contacting the Service Provider)

10.2. Termination by the Service Provider

The Service Provider may suspend or delete a User's Account in the event of:

  • Violation of these Terms of Service
  • Actions detrimental to the Service Provider or other Users
  • Using the App in an unlawful manner
  • Providing false information during registration

In the event of Account suspension, the User will be informed of the reasons and may appeal the decision.

10.3. Effects of Termination

  • The User loses access to the App and all features
  • User data will be deleted in accordance with the Privacy Policy
  • The unused portion of the Subscription is not refundable (unless termination was due to the Service Provider's fault)

11. Complaints

11.1. Complaints - Consumers

The Service Provider is liable for any Non-conformity of the Service with the Agreement revealed during the period of Service delivery.

In the event of a Non-conformity, the User may file a complaint requesting that the Service be brought into conformity with the Agreement.

Complaints are submitted via email to: contact@merdilo.com.

A complaint should contain:

  • The User's account email address
  • Description of the Non-conformity
  • Request to bring the Service into conformity with the Agreement

The Service Provider responds to complaints via email within 14 days of receipt.

If the complaint is accepted, the Service Provider shall, at its own cost, bring the Service into conformity with the Agreement within a reasonable time, without excessive inconvenience to the User.

The User may submit a statement of withdrawal from the Agreement when:

  • Bringing the Service into conformity with the Agreement is impossible or requires excessive costs
  • The Service Provider has not brought the Service into conformity within a reasonable time
  • The Non-conformity persists despite attempts to bring the Service into conformity
  • The Non-conformity is so significant that it justifies immediate withdrawal from the Agreement
  • It is clear from the Service Provider's statement or circumstances that the Service will not be brought into conformity within a reasonable time

11.2. How to File a Complaint

12. Service Changes

The Service Provider may modify the Service in the event of:

  • The need to adapt the Service to new devices or software
  • Service improvement through adding new features or modifying existing ones
  • Legal obligation to make changes, including adapting the Service to current legal requirements

Service changes may not result in additional costs for the User.

The Service Provider informs the User about Service changes through an in-app notification or by email.

If a Service change significantly and negatively affects the User's access to the Service, the Service Provider is obliged to inform the User no later than 7 days before the change, indicating:

  • The nature and date of the change
  • The User's right to terminate the Agreement with immediate effect within 30 days of the change

13. Changes to the Terms

  • The Service Provider reserves the right to amend these Terms of Service
  • Users will be notified of significant changes via an in-app notification and by email (if they have an Account)
  • Changes take effect on the date specified in the notification, no sooner than 14 days from the announcement date
  • Continued use of the App after changes take effect constitutes acceptance thereof
  • If the User does not accept the changes, they have the right to delete their Account before the changes take effect
  • Agreements concluded before the amendment of the Terms of Service shall be governed by the Terms of Service in force at the time of conclusion of the Agreement

14. Dispute Resolution

In the event of a dispute related to the use of the App:

  • The User may use out-of-court complaint and claim resolution methods, including:
  • The above does not exclude the possibility of pursuing claims before a court of law

15. Final Provisions

  • These Terms of Service are governed by Polish law
  • Matters not regulated herein shall be governed by the provisions of Polish law, in particular the Civil Code, the Act on Providing Services by Electronic Means and the Consumer Rights Act
  • If any provision of these Terms is deemed invalid, the remaining provisions shall remain in force
  • Any disputes arising from these Terms shall be resolved by the court having jurisdiction over the Service Provider's registered office, subject to mandatory provisions on jurisdiction for consumers
